Despite an adverse liability ruling, Dell avoids significant damages

Coherent Economics Senior Managing Director Jeff Andrien testified successfully in a jury trial in Georgia federal court. Coherent’s client, Dell Inc., was sued by Acceleron LLC, a non-practicing entity that alleged Dell had infringed on a patent relating to blade server design in several of Dell’s products.

At trial, the plaintiff’s expert opined that Acceleron had suffered damages of over $50 million as a result of the alleged infringement, while Dell’s expert Jeff Andrien opined that damages were $2.1 million. After deliberating, the jury found that Dell had infringed on Acceleron’s patent, but fully adopted Jeff Andrien’s damages number of only $2.1 million, rejecting the plaintiff’s expert’s opinion.
